By accessing or using scalelocally.ai, our chat widget, lead forms, booking calendar, or any of our services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our website or services. These terms constitute a binding agreement between you and Scale Locally ("Company," "we," "our," or "us").

2. About Scale Locally

Scale Locally is a marketing and technology agency serving contractors and local service businesses across the United States. We provide high-converting websites, the Scale Locally OS CRM, AI agents (voice, sales, scheduling, and reputation), review automation, missed-call text-back, local SEO, all-in-one inbox, and Meta (Facebook & Instagram) advertising management. Our services are offered under the Scale Locally brand and through our subscription plans.

3. Services & Subscription Plans

We offer the following subscription plans. Plan features and pricing are subject to change without notice. Visiting this website or signing up for a plan does not guarantee specific business results.

• Foundation ($97/month) — Custom high-converting website, Scale Locally OS CRM, calendar integration, and core tools.
• Growth ($197/month) — Everything in Foundation plus review automation, email marketing, and additional lead-generation tools.
• Apex ($297/month) — Everything in Growth plus Meta Ads Launcher with AI booking engine for automated lead follow-up and appointment booking.
• Scale ($750/month + ad spend) — Done-for-you ad management with a 10X Pipeline Value Guarantee, monthly performance reviews, and full lead delivery. Ad spend is separate, starting at $20/day.

All subscriptions are billed monthly. You may cancel at any time, subject to the cancellation and data export terms in Section 7. Since there is no setup fee for your website, the website is built and hosted through your subscription and connected to our CRM and marketing tools. If you cancel, the site comes down, but you keep your domain and can export all website files, contacts, and data.

4. Use of This Website

You agree to use this website only for lawful purposes. You may not:

• Use this site to transmit harmful, offensive, or unlawful content
• Attempt to gain unauthorized access to any part of the site, our systems, or our CRM
• Use automated tools, bots, or scrapers to copy or extract content without permission
• Misrepresent your identity, business, or affiliation with another party
• Interfere with the proper functioning of the chat widget, forms, or booking calendar
• Submit false, misleading, or fraudulent information through our forms
• Use our services to send unsolicited communications or engage in spam

5. Accounts & Access

When you subscribe to a plan, you may receive access to the Scale Locally OS CRM and related tools. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

6. SMS & Messaging Consent

By providing your phone number through our website, forms, chat widget, or booking calendar, you consent to receive calls and text messages from Scale Locally and our authorized providers. This includes appointment reminders, onboarding updates, service notifications, missed-call text-back messages, and customer support communications. Message and data rates may apply. You may opt out at any time by replying STOP. Consent is not a condition of any purchase. Full details are in our Privacy Policy.

7. Cancellation & Data Export

You may cancel your subscription at any time. Because your website is built and hosted through your subscription with no setup fee, the following applies upon cancellation:

• Your hosted website will be taken down.
• You retain ownership of your domain name.
• You may export your website files, contacts, leads, and data before cancellation is finalized.
• CRM access and connected tools (AI agents, automations, review system, etc.) will be deactivated.
• We are not liable for loss of data if you do not export your information prior to cancellation.

8. Advertising & Performance

For plans that include Meta advertising (Apex and Scale), the following terms apply:

• Ad spend is separate from your monthly subscription fee and is billed directly through your Meta ad account or through us at your direction.
• You are responsible for funding your ad budget. We are not liable for campaigns paused or suspended due to insufficient ad spend.
• We optimize campaigns based on best practices, but advertising results vary and depend on factors outside our control, including market conditions, competition, and offer quality.
• The 10X Pipeline Value Guarantee (Scale plan) applies to qualifying clients and is subject to the specific terms outlined in your client agreement. If the guarantee is not met, remedies are limited to those described in your signed agreement.
• We make no guarantees regarding specific lead volume, call volume, revenue, or return on ad spend.

9. Intellectual Property

All content on this website — including text, graphics, logos, designs, software, and marketing materials — is the property of Scale Locally and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from this site without our written permission.

Client-provided content (logos, images, copy) remains the property of the client. We retain the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.

10. Third-Party Services

Our services integrate with third-party platforms, including CRM providers, chat widgets, form embeds, calendar systems, payment processors, SMS providers, and Meta advertising platforms. We are not responsible for the availability, performance, or policies of these third-party services. Your use of such services may be subject to their own terms and conditions.

11. Payment & Billing

Subscription fees are billed monthly through our secure checkout pages. You authorize us to charge your payment method for all applicable fees. If a payment fails, we may suspend access to your services until payment is resolved. Prices are subject to change with reasonable notice. Refunds, if any, are governed by the terms of your specific plan and client agreement.

12. Limitation of Liability

To the fullest extent permitted by law, Scale Locally shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our services. This includes, but is not limited to, loss of revenue, loss of leads, loss of data, business interruption, or damage to reputation. Our total liability for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim. We make no guarantees regarding specific business outcomes, including leads, calls, bookings, rankings, or revenue.

13. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure, or that any specific results will be achieved.

14. Indemnification

You agree to indemnify and hold harmless Scale Locally, its officers, employees, and partners from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of our website or services, your violation of these terms, or your infringement of any third-party rights.
